1. Agreement to these terms
These Terms & Conditions form an agreement between you and Richie McMullen (AtomCoder), the developer and publisher of LocalShare. They apply to the LocalShare applications, website, installers and related services.
By downloading, installing, accessing or using LocalShare, you agree to these terms and the Privacy Policy. If you do not agree, do not use LocalShare. If you use LocalShare for an organisation, you confirm that you have authority to accept these terms for that organisation.
2. What LocalShare provides
LocalShare is a local-network utility for discovering nearby devices and transferring files, folders and clipboard text between supported macOS, Windows and Android devices. Native app-to-app transfers are intended to travel directly between selected devices without using the LocalShare website as a relay.
Some functions depend on your operating system, local network, firewall, permissions, storage, other devices and third-party software. The optional browser receiver uses local HTTP and has different security properties from encrypted native transfers.
3. Limited licence
Subject to these terms, you receive a limited, non-exclusive, non-transferable and revocable licence to install and use LocalShare on devices you own or control for personal or lawful internal business purposes. This licence does not transfer ownership of LocalShare or its branding.
Unless applicable law or a separate open-source licence permits it, you may not sell, sublicense, rent, distribute a modified build as LocalShare, remove ownership notices, misuse LocalShare branding, or reverse engineer the software except to the extent that such a restriction is prohibited by law.
4. Acceptable use
You must use LocalShare lawfully and with the permission of the people and organisations whose devices, networks and content are involved. You must not:
- send unlawful, infringing, malicious, deceptive or harmful material;
- send content to a person who has not agreed to receive it, or attempt to bypass an acceptance or verification step;
- probe, attack, disrupt or overload a device, network, website or LocalShare feature;
- introduce malware, exploit code or files intended to damage, monitor or gain unauthorised access;
- impersonate another device or person, misrepresent the origin of a transfer, or use misleading device names for abuse; or
- use LocalShare in a way that violates privacy, intellectual-property, export-control, sanctions or other applicable law.
5. Your files and responsibilities
You keep ownership of your files and other content. You are solely responsible for selecting the correct content and recipient, having the right to transfer it, complying with confidentiality duties, and checking received content before opening it.
LocalShare does not keep a server-side backup of native transfers. You are responsible for maintaining appropriate backups and confirming that a transfer completed successfully before deleting an original. File names, history, queue data and received items may remain on the participating devices until cleared or deleted there.
6. Network and device security
You are responsible for securing your devices, accounts, local network and receive folders. Keep LocalShare and your operating system updated, compare verification codes where shown, and reject unexpected transfers.
Enable auto-accept or the browser receiver only on trusted devices and networks. Anyone who obtains access to a browser-receiver address and code while it is active may attempt an upload. Native encryption protects data in transit between compatible LocalShare apps, but it does not protect a compromised sender, recipient or local device.
7. Third-party services and software
LocalShare may link to app stores, PayPal, GitHub or other services and relies on operating-system and network functionality. Those products are controlled by their respective providers and may have separate terms, privacy policies and fees. Their availability and conduct are not controlled by LocalShare.
Components distributed under open-source licences remain subject to their applicable licences. If there is a conflict concerning an open-source component, its licence controls for that component.
8. Updates, changes and availability
LocalShare may add, change, suspend or remove features, supported platforms, download channels or compatibility when reasonably necessary for security, maintenance, legal compliance or product development. Updates may be required for compatible and secure transfers between devices.
No particular feature, store listing, website, download or support response time is guaranteed. Preview, debug or unsigned builds may display operating-system warnings and may be less stable than a signed production release.
9. Disclaimers
To the maximum extent permitted by law, LocalShare is provided “as is” and “as available”. No guarantee is made that it will always be uninterrupted, error-free, compatible with every device or network, or suitable for highly sensitive, safety-critical or regulated transfers.
You should independently verify important transfers and keep backups. Nothing in these terms excludes any warranty, remedy or statutory consumer right that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, the developer is not liable for indirect or consequential loss, lost profits, lost business, loss of opportunity, loss or corruption of data, failed transfers, unauthorised access caused by your network or device, or harm caused by content sent or received by users.
Nothing in these terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law. Any limitation is subject to the mandatory rights available to you as a consumer.
11. Suspension and termination
You may stop using LocalShare at any time and uninstall it. Access to website services or future online features may be suspended or terminated where reasonably necessary to address abuse, security risks, legal requirements or a material breach of these terms.
Terms that by their nature should continue after termination—including ownership, disclaimers, liability limits and governing law—will continue to apply.
12. Changes, governing law and contact
These terms may be updated to reflect changes to LocalShare, security, law or business practices. The effective date will be updated on this page. If a material change affects continued use, reasonable notice will be provided through the app or website where practical.
These terms are governed by the laws of Ireland. The courts of Ireland will have jurisdiction, except that consumers retain the benefit of any mandatory protections and court rights provided by the law of their country of residence.
If any provision is unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver of that right. These terms and the Privacy Policy are the entire agreement concerning the covered LocalShare services unless separate written terms apply.
For questions about these terms, contact Richie McMullen (AtomCoder) through the AtomCoder developer profile.
